Welcome to Pothole Patrol (PotholePatrol.co.uk). By downloading our app or using our platform, you agree to the following terms. Please read them carefully as they define your rights and our role in your dispute with local authorities.

1. The Service Provided

Pothole Patrol is a Civic Accountability Tool. We provide:

  • GPS-verified, time-stamped evidence-logging technology.
  • Automated reporting to UK Local Authorities.
  • Legal templates (Forms A, B, and C) based on the Highways Act 1980 and common law principles of service-level grievances.
  • A national data-sharing platform to highlight council negligence.

2. No Legal Advice

Pothole Patrol is not a law firm. The information provided on the website and within the app—including the "Strike Guide" and MP letters—is for informational and educational purposes only.

  • While our templates use professional legal language, they do not constitute formal legal advice.
  • Users are encouraged to consult a qualified legal professional if they are facing specific litigation or enforcement action from a local authority.

3. The "Service Dispute" & Council Tax

Pothole Patrol provides the framework for a structured service dispute.

User Responsibility: The decision to withhold or "strike" any portion of Council Tax is the sole responsibility of the user.

The Escrow Recommendation: Pothole Patrol strongly recommends that all users move disputed funds into a separate, secure "Escrow" account. This proves "the will and means to pay," which is a vital defense in any potential debt hearing.

Liability: Pothole Patrol is not liable for any fines, late fees, or enforcement actions taken by a council against a user. We provide the tools for the dispute; the user manages the execution.

4. Accuracy of Data

By using the app, you agree to provide truthful and accurate photos and location data.

  • Falsifying road defect reports is a breach of these terms and may undermine the collective credibility of the Pothole Patrol network.
  • Pothole Patrol reserves the right to remove any reports found to be fraudulent or malicious.

5. One-Time Download Fee

The download fee is a one-time annual payment for 12 months' access to the Pothole Patrol app and its integrated legal toolkit.

  • This fee supports the maintenance of the National Heat-map and the lobbying efforts of the Pothole Patrol movement.
  • Refunds are only issued in accordance with standard App Store and Google Play Store policies.

6. Limitation of Liability

Pothole Patrol (and its parent company) shall not be held liable for any vehicle damage, personal injury, or financial loss resulting from road defects or the user's interaction with local authorities. Our mission is to provide the evidence for you to seek your own redress.

7. Privacy & Data Usage

Your privacy is paramount. We are committed to protecting your personal information and being transparent about how we use it.

What We Collect: When you use Pothole Patrol, we collect your email address, name, and GPS location data for reports you submit. Photos you upload are stored securely to support your formal notices.

How We Use Your Data:

  • To file reports and serve formal notices to Local Authorities on your behalf.
  • To populate the National Heat-map showing road defect hotspots.
  • To send you important updates about your reports and account.
  • To improve our service and user experience.

What We Will NEVER Do:

  • We will NEVER sell your personal contact details to third parties.
  • We will NEVER share your individual data with advertisers or marketing companies.
  • We will NEVER use your data for purposes unrelated to Pothole Patrol's civic mission.

We may share aggregated, anonymous data (e.g., "500 reports in Warwickshire") with the media and MPs to drive national change. This data cannot be traced back to individual users.
