Our commitment to you. Pothole Patrol is a referral platform, not a data product. You are subscribing for pre-evidenced, GPS-verified compensation referrals delivered directly to your nominated claims inbox. This document sets out exactly how many referrals you will receive, what each referral contains, what happens if we fall short, and what happens when demand exceeds your tier's ceiling. This statement forms part of the Terms & Conditions agreed at the point of subscription.

Context on value: The average UK road defect compensation claim settled out-of-court is between £1,500 and £15,000. At a 30% success rate and a typical 25% contingency fee, a single successful referral returns £375–£3,750 to the firm. The annual subscription is recovered from as little as one successful case.
What Constitutes a Valid Referral
Every referral counted against your annual guarantee must meet all five of the following criteria before it is dispatched to your inbox:
- GPS-verified location: The defect coordinates are captured at the point of report on the claimant's device. Manually entered postcodes are not accepted.
- Photographic evidence: At least one photograph of the defect has been submitted. Up to five images are attached to every referral.
- Council formally notified: Pothole Patrol has automatically forwarded the report to FixMyStreet, generating a council reference number. The Section 58 clock is running from this notification.
- 28-day repair window expired: The council has had a minimum of 28 days since formal notification and the defect remains unresolved. Every referral arrives with the exact number of days elapsed — all referrals are therefore past the Section 58 liability window.
- Claimant pre-consent obtained: The user has provided their name, phone number, and email address and explicitly consented to being contacted by the assigned solicitor firm in connection with a compensation claim.
Every referral also includes: a court-ready Evidence Pack PDF (cover page, chain of custody, photographic evidence, legal background) generated automatically by Pothole Patrol — no solicitor input required before receipt.
Delivery Method & Timeline
- Email delivery: Referrals are sent to the firm's nominated claims email address provided at subscription signup. This can be updated at any time by contacting corporate@potholepatrol.co.uk.
- Delivery time: Referrals are dispatched within 24 hours of the claimant submitting their compensation request via the Pothole Patrol platform.
- Exclusivity: Each referral is sent to one firm only — the firm assigned to the relevant region at the time of the claim. No referral is sent to multiple firms simultaneously.
- Rotation: Where multiple firms cover the same region, referrals are allocated on a fair-rotation basis to ensure equitable distribution.
- Acknowledgement expected: We ask that your firm acknowledges receipt within 5 working days. Persistent non-acknowledgement may result in the referral being re-assigned to protect the claimant's interests.
Geographic Allocation
Referrals are matched to firms based on the UK regions selected at signup. The claimant's GPS coordinates determine the region; the referral is dispatched to the active subscribing firm assigned to that region.
- A Local subscriber covering Greater London receives all eligible claims originating from Greater London.
- A Regional subscriber covering South East + South West + Greater London + East of England receives all eligible claims from across those four regions.
- A National subscriber receives eligible claims from any of the nine or more regions they have selected, subject to the annual maximum.
If We Fall Short of the Minimum
Pothole Patrol guarantees a minimum number of valid referrals per subscription year. If we do not deliver the guaranteed minimum by the end of the 12-month subscription period, one of the following remedies will apply at the firm's election:
Option A — Pro-Rata Credit
A credit equal to the proportional shortfall is applied to the firm's renewal invoice. The subscription renews at the full rate less the credit, with no action required from the firm.
Example — Local tier: Guaranteed minimum: 3 · Referrals delivered: 2 · Shortfall: 1
Credit = (1 ÷ 3) × £3,000 = £1,000 off renewal
Example — Regional tier: Guaranteed minimum: 6 · Referrals delivered: 4 · Shortfall: 2
Credit = (2 ÷ 6) × £6,000 = £2,000 off renewal
Option B — Full Refund
If the firm elects not to renew, a full refund of the subscription fee is available where zero valid referrals were delivered during the subscription year. Where at least one valid referral was delivered, Option A applies unless otherwise agreed in writing.
To request a refund or credit, contact corporate@potholepatrol.co.uk within 30 days of the subscription anniversary date. Refunds are processed within 10 working days.
If Referral Volume Exceeds the Maximum
Platform growth or media events may cause referral demand to temporarily exceed a tier's annual ceiling. The following policy applies:
- Overflow priority: Referrals in excess of the annual maximum are held in a priority queue for the subscribing firm and offered first at the start of the next subscription year.
- Immediate delivery option: The firm may elect to receive overflow referrals immediately at no additional cost, subject to a written request to corporate@potholepatrol.co.uk. Approval is at Pothole Patrol's discretion based on fair-use obligations to other subscribing firms.
- Tier upgrade: A firm consistently hitting its ceiling within the subscription year will be offered a mid-year tier upgrade at a pro-rata rate to increase their annual maximum.
What Pothole Patrol Does Not Guarantee
- The outcome of any individual referral — claim success, compensation amount, or court result. Pothole Patrol is a referral and evidence platform, not a legal services provider.
- The claimant's willingness to proceed after initial referral — personal circumstances may change after consent is given.
- The specific calendar timing of individual referrals within the subscription year — delivery depends on user activity and report volume in your covered regions.
- That every referral will result in an instructable case — Pothole Patrol provides the evidential foundation; the legal merits are for the solicitor firm to assess.
- Claims arising from private roads, car parks, or land not maintained by a local highway authority under the Highways Act 1980. Only public highway defects are in scope.

| Data protection | Claimant personal data is shared under a Data Processing Agreement (DPA). Firms must not use claimant data for any purpose other than assessing and pursuing the specific referred claim. |
| Regulatory compliance | Subscribing firms must hold a valid SRA authorisation. Pothole Patrol reserves the right to suspend referrals to any firm under regulatory investigation. |
| Governing law | This guarantee is governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the English courts. |
